Common Motorcycle Accident Injuries

As a biker, you have rights. By design, motorcycles offer nothing in the way of external protection in the event of an accident, so when your rights are violated by the negligent operator of a car, truck, van, SUV, or other passenger vehicle, you are the one most likely to be seriously injured. Tragically, thousands of motor vehicle accidents each year result in the death of the motorcyclist, and in many of those cases, the motorcyclist was not at fault. At the law firm of Tipp Coburn Schandelson PC, we have been dedicated to representing injured Montanans and their families since 1959. When it comes to representing victims of motorcycle accident injuries,

Tipp & Buley, Montana Innocence Project overturn conviction, secure release for client

Tipp & Buley client Richard Raugust was freed from custody for the first time in over 18 years on Friday, December 4, after Judge Jim Wheelis overturned his conviction and life sentence for deliberate homicide in November. Richard is represented by Tipp & Buley Shareholding Attorney Brett D. Schandelson, in cooperation with the Montana Innocence Project.  Brett was asked by the Montana Innocence Project to represent Richard in 2013 on a pro bono basis, and has since volunteered over 400 hours to Richard’s case. After hundreds of pages of pleadings and a new evidence hearing in 2014, Judge Wheelis ruled on November 16, 2015 that Richard’s rights under Brady v. Maryland, which

Can You Recover Losses Resulting from Fraud?

Montana law specifically recognizes that a lawsuit may be brought for fraud. As in most states, fraud in Montana may be “either actual or constructive.” In oversimplified terms, actual fraud requires an intent to deceive someone, a “lie.” Constructive fraud, on the other hand, does not. To prevail in a case of actual fraud in Montana, a party must prove nine things. A representation was made; It was false; It was material; The person who made the representation knew it was false; The person who made the representation intended that it be relied on; The person who heard the representation did not know that it was false; The person who heard the

Is Breaking the Law an Act of Negligence?

Personal injury cases are most always premised on an act of negligence on the part of one person that resulted in an injury to another. Negligence, in a tort case, means that a person or entity had a legal duty to act in a certain way but failed to do so. If another person suffered an injury as a result, the makings of a personal injury lawsuit have been sown. Personal injury cases often have many details bearing on whether a legal duty existed and whether it was breached. In some cases, however, the question of duty is quite simple. If the injury resulted from the defendant having broken a law,

What Could Joint and Several Liability Mean to Me?

If you’ve suffered a personal injury for which there are multiple potential causes, joint and several liability may come into play. Although the terminology may sound complicated, joint and several liability is a fairly simple concept. It’s based on two ideas: (1) the notion that everyone who might have been involved in an accident or injury should be in the same lawsuit; and (2) the injured party should not miss out on a full recovery if one of the causes of the accident or injury cannot pay. A person who has been injured and files a lawsuit to recover damages is known as the plaintiff. The person being sued is known as

Bear Poaching Not Taken Lightly in Montana

Outdoor activities such as hunting and fishing are important to Montana’s tourism industry as well as to state residents. Unfortunately, there are those, both residents and visitors, who take advantage of the state’s abundant wildlife and rural setting by poaching. Poaching is the illegal killing of fish or wildlife. It is mostly the killing of animals out of the regular hunting season, killing more than are allowed during season, and killing endangered species. Because of the wide open space that makes Montana so unique, it is hard for the state to know just how much poaching takes place. It is believed that, increasingly, out of state criminal rings are illegally
